USTR Designates Vietnam as Priority Foreign Country, Adds EU to Watch List in 2026 Special 301 Report

The USTR released its 2026 Special 301 Report on April 30, designating Vietnam as a Priority Foreign Country and adding the EU to the Watch List for the first time.

Vietnam PFC Designation

The designation activates a 30-day window for USTR to initiate a Section 301 investigation. Concerns include online piracy and inadequate IP enforcement.

Priority Watch List

Chile, China, India, Indonesia, Russia, and Venezuela remain on the Priority Watch List.

EU on Watch List

The EU joins 18 others including Argentina, Brazil, Canada, Mexico, and Thailand. Concerns center on pharmaceutical data exclusivity and digital copyright policy.

Argentina and Mexico Reclassified

Both countries improved IP policy and were reclassified to the Watch List. Mexico’s shift is partly attributable to USMCA reforms. Bulgaria was removed.

Implications
